KSEB OR AUDIT OFFICER CANNOT REVISE PENAL BILL ONCE FINALIZED UNDER THE ELECTRICITY ACT 2003 SECTION 126 BY THE ASSESSING OFFICER

The Assistant Engineer is not empowered to revise, reopen or rectify the assessment of penal bill once finalized under section 126 of Electricity Act 2003 on the report of the Audit Officer. The High Court of Kerala while considering a case of temporary connection obtained to a newly constructed building of a company without permission of the KSEB the penalty bill was fixed earlier for Rs 2.45 lakh being revised to Rs 14.76 lakh by an instruction issued by the Audit Officer.
The High Court rules that KSEB cannot revise a penal bill that is once imposed to a consumer and asked to pay according to the revised penal bill of Rs 14.76 lakh issued by the Asst. Engineer quashed by the High Court of Kerala.
